Division of Florida Condominiums, Timeshares and Mobile HomesNOTICE IS HEREBY GIVEN that the Division of Florida Condominiums, Timeshares, and Mobile Homes, Department of Business and Professional Regulation, State of Florida, has issued an order disposing of the petition for declaratory statement filed by Mark F. Grant, Esq., In Re: De Soleil South Beach Residential Condominium Association, Inc., Docket No. 2013015521, on April 4, 2013. The following is a summary of the agency's disposition of the petition:
The Division declines to answer the question of whether the election rule, chapter 61B-23, Florida Administrative Code, applies to the association’s election. The Division finds that De Soleil South Beach Residential Condominium is not a “residential condominium” under Section 718.103(23), Florida Statutes. The statement was filed with the Agency Clerk on May 31, 2013.
