NOTICE IS HEREBY GIVEN that on June 10, 2013, the Department of Environmental Protection, received a petition for permanent variance or wavier from Joseph Bank, Charles Russell, and Apples and Oranges, Inc. The petition requested a variance/waiver from subsections 62B-33.002(18) which defines “Eligible Structures; 62B-33.002(43) which defines “Nonconforming Structure”; 62B-33.002(63) which defines “Vulnerable”; and 62B-33.0051(1)(a)l., F.A.C., which states that “Construction of armoring shall be authorized under the following conditions: 1. The proposed armoring is for the protection of an eligible structure;”. The variance is associated with an application to construct a coastal armoring structure. The activity is located at 1805 SE Sailfish Point Blvd, 1855 SE Sailfish Point Blvd., and 1755 S.E. Sailfish Point Blvd. in Stuart, FL 34996. The petition has been assigned File No. MI-525 AR V.
