NOTICE IS HEREBY GIVEN THAT on May 23, 2008, the Department of Environmental Protection, Bureau of Beaches and Coastal Systems, received a petition for a variance or waiver pursuant to Section 120.542, F.S. and Rule 28-104, F.A.C. The petition requests a variance from or waiver of the requirements of subsections 62B-33.002(18), (63), F.A.C., which provides the definitions of “eligible structures” and “vulnerable” respectively, and from paragraph 62B-33.0051(1)(a), F.A.C., which states the conditions where armoring may be authorized. The petition was submitted by Charles W. Fleming, Jr., and John E. Fleming. The property is located 490 Blue Mountain Road, Santa Rosa Beach, Florida.
