    PURPOSE AND EFFECT: The proposed rule incorporates two updated Department of Health forms regarding Hearing Aid Specialists training program. There are also other minor changes within the forms.

    SUMMARY: The proposed rule amendment updates and incorporates Hearing Aid Specialist Application for Examination, Form DH-MQA 1155 and Training Program Continuation Request, Form DH-MQA 1160 for licensures by examination.

    SUMMARY OF STATEMENT OF ESTIMATED REGULATORY COSTS AND LEGISLATIVE RATIFICATION:

    The Agency has determined that this will not have an adverse impact on small business or likely increase directly or indirectly regulatory costs in excess of $200,000 in the aggregate within one year after the implementation of the rule. A SERC has not been prepared by the Agency.

    The Agency has determined that the proposed rule is not expected to require legislative ratification based on the statement of estimated regulatory costs or if no SERC is required, the information expressly relied upon and described herein: During discussion of the economic impact of this rule at its Board meeting, the Board, based upon the expertise and experience of its members, determined that a Statement of Estimated Regulatory Costs (SERC) was not necessary and that the rule will not require ratification by the Legislature. No person or interested party submitted additional information regarding the economic impact at that time. Any person who wishes to provide information regarding a statement of estimated regulatory costs or provide a proposal for a lower cost regulatory alternative must do so in writing within 21 days of this notice.

    THE FULL TEXT OF THE PROPOSED RULE IS:

     

    64B6-8.003 Trainee Stages, Minimum Training Requirements, and Training Programs.

    (1) through (2) No Change.

    (3) The sponsor shall file a complete Training Program Sponsor Report with the Board; this report shall be filed no later than 30 days after the completion of the program or termination of the sponsorship, whichever occurs first. The report shall set forth the number of hours of training in each subject which has been provided. The report must also set forth the educational and training objectives and hours set by the sponsor for the trainees. Hearing Aid Specialist Application for Examination, Form 1155 (revised 04/2024 7/2023), hereby adopted and incorporated by reference, and can be obtained from http://www.flrules.org/Gateway/reference.asp?No=Ref-15953 or the Board of Hearing Aid Specialists’ website at http://www.doh.state.fl.us/mqa/HearingAid/. Failure to comply with the requirements of this rule may subject the sounsor to discipline.

    (4) through (5) No Change.

    (6) A trainee who fails the licensure examination must immediately stop functioning as a trainee upon receipt of the examination results. However, a trainee may continue one time in Stage IV of the training program by submitting to the Board within 10 days of receiving the examination results a Training Program Continuation Request (Form DH-MQA 1160, Revised 04/2024   7/2023) and hereby adopted and incorporated by reference, and can be obtained from http://www.flrules.org/Gateway/reference.asp?No=Ref-15954  or the Board of Hearing Aid Specialists’ website at http://www.doh.state.fl.us/mqa/HearingAid/) and taking the next available examination. A trainee who fails the licensure examination and does not submit a Training Program Continuation Request to the Board within 10 days of receiving the examination results may repeat the training program one time by meeting the criteria in Rule 64B6-8.002, F.A.C., and taking the next available examination.

    (7) No Change.
