NOTICE IS HEREBY GIVEN that the Board of Nursing has issued an order disposing of the petition for declaratory statement filed by Donald Mitchell on December 6, 2018. The following is a summary of the agency's disposition of the petition: The Notice of Petition for Declaratory Statement was published in Vol. 44, No. 243, of December 17, 2018 in the Florida Administrative Register. The Petitioner sought a Declaratory Statement from the Board with regards to whether it is within the scope of practice of a registered nurse or a licensed practical nurse, as defined in 464, F.S., to provide Battlefield Acupuncture therapy to patients. The Board considered the instant Petition at a duly-notice meeting on February 7, 2019 in Howey-in-the-Hills, Florida. The Board’s Order, filed on April 17, 2019, finds that it declines to respond to the Petition as it is not properly presented.
