Unemployment is a persistent problem for individuals with disabilities. In addition to prejudice and discrimination against individuals with disabilities, many disincentives exist that present further barriers to employment. Individuals who receive certain government benefits are limited to the amount of income they can earn or risk loss of benefits. Often the amount earned is very small compared to the potential loss of benefits, such as medical care and medications, residential care and support.
Mr. William C. Farris is an individual with developmental disabilities who after becoming employed was terminated from the Home and Community Based Service (HCBS) Medicaid Waiver Program, as he earned more money than was allowable under government regulations. On November 8, 2006, the State of Florida First District Court of Appeal affirmed the termination of Mr. Farris eligibility, leaving him unable to maintain his independence in the community and heralding the potential loss of services for other individuals similarly situated. The case is referred to as Farris v Department of Children and Family Services (DCF).
A full review and analysis of the ramifications of the Farris case is needed to understand the potential impact of the ruling, to identify areas where disincentives for independence and self-sufficiency exist and explore how they can be eliminated. Further, information is needed by individuals with developmental disabilities and those who support them in understanding where disincentives exist and how to avoid the loss of benefits. To begin this process, the Employment Task Force is seeking a contractor to develop a White Paper to address these issues and make recommendations to the Council regarding the removal of work disincentives and in consumer education.
Submission of written questions and letters of intent are encouraged of all prospective proposers. The deadline for submitting written questions and letters of intent for this RFP is Friday, July 6, 2007, by 4:00 p.m. (EDT). Letters of intent will only be accepted by fax, mail, or hand delivery. Letters of intent by email will not be accepted. All answers to written questions will be posted on the FDDC website during the week of July 23, 2007. The deadline for submitting proposals for this RFP to FDDC is Friday, August 20, 2007, by 2:00 p.m. (EDT).
