NOTICE IS HEREBY GIVEN THAT ON May 24, 2006, the Department of Health, filed an Order disposing of a Petition for Waiver from the requirements of paragraph 64E-15.003(3)(b) and subsection 64E-15.004(6), Florida Administrative Code, as filed by John Simon, Petitioner for Forest Village RV Park. The petition was filed with the Department on August 1, 2005, and noticed in the Florida Administrative Weekly on August 26, 2005, Vol. 31, No. 34.

The Department determined that Petitioner’s Waiver request failed to meet the provisions of Rule Chapter 64E-15, Florida Administrative Code, and Rule Chapter 28-104, Florida Administrative Code, in that the relief requested did not match the rule referenced; the Petitioner’s Waiver request failed to meet the provisions of Rule Chapter 28-104, Florida Administrative Code, in that the petition failed to properly cite the statute the rule is implementing; and the petition failed to state how the waiver would serve the underlying purposes of the statute. Therefore, the Petition for a permanent Waver is DENIED.
