The Florida Department of Elder Affairs hereby gives notice: that on 01/17/2019, the Department of Elder Affairs received a petition for Variance from Rule 58A-5.036 from Benign Care, LLC d/b/a Autumn Way. The notice of the petition was published in the Florida Administrative Register on 03/22/2019 in Volume 45 Issue No. 57. Petition denied on 06/05/2019. Petitioner, inter alia, failed to demonstrate the purpose of the underlying statute would be satisfied.
