    NOTICE IS HEREBY GIVEN that the Division of Florida Condominiums, Timeshares, and Mobile Homes, Department of Business and Professional Regulation, State of Florida, has received the petition for declaratory statement from Jean Mesler, Carol Tabaka, and Susan Pikus, Unit Owners, In Re: Isla Merita Homeowners’ Condominium Association II, Inc., Docket No. 2014024764, filed on June 11, 2014. The petition seeks the agency’s opinion as to the applicability of subsection 718.110(4), Florida Statutes, as it applies to the petitioner.

    Whether Isla Merita Homeowners’ Condominium Association II, Inc. may convert common element association property to limited common elements upon an amendment to the declaration without the approval of all unit owners pursuant to subsection 718.110(4), Florida Statutes, where the property at issue is a portion of the ground around all units.
