65C-45.003Foster Home Initial Licensing Requirements for all Levels of Licensure

The Department of Children and Families hereby gives notice: An order was issued disposing of the petition for waiver of subsection 65C-45.003(2), Florida Administrative Code, from Family Partnerships of Central Florida. The Notice of Variances and Waivers was published on May 2, 2024, in volume 50, number 87 of the Florida Administrative Register. Subsection 65C-45.003(2), Fla. Admin. Code, requires community-based care lead agencies participating in the attestation model for license to enter into a Memorandum of Agreement with the Regional Licensing Office. The pertinent Memorandum is incorporated by reference in paragraph 65C-45.003(2)(b). Petitioner requested to waive the requirement for side-by-side reviews prior to participating in the attestation model for licensure.

The petition for waiver was granted because Petitioner demonstrated a substantial hardship and showed that the underlying purpose of the statute will likely be achieved.
