PURPOSE AND EFFECT: The purpose and effect of the proposed rule amendment is to update the language incorporating Application for Diethyl Ether Permit and the Application for Diethyl Ether Permit Renewal forms.

SUBJECT AREA: The subject area to be addressed in this rule is to update the language incorporating the two diethyl ether forms

SUMMARY: Updated language incorporating =diethyl ether permit application and renewal forms.

SUMMARY OF STATEMENT OF ESTIMATED REGULATORY COSTS AND LEGISLATIVE RATIFICATION:

The Agency has determined that this will not have an adverse impact on small business or likely increase directly or indirectly regulatory costs in excess of $200,000 in the aggregate within one year after the implementation of the rule. A SERC has not been prepared by the Agency.

The Agency has determined that the proposed rule is not expected to require legislative ratification based on the statement of estimated regulatory costs or if no SERC is required, the information expressly relied upon and described herein: Department’s economic analysis of the potential impact of the proposed rule and its determination that there will be no adverse economic impact or increased regulatory costs that would require legislative ratification.

Any person who wishes to provide information regarding a statement of estimated regulatory costs, or provide a proposal for a lower cost regulatory alternative must do so in writing within 21 days of this notice.

(1) Any person requiring a license or permit may request an Application for Permit as a Diethyl Ether Manufacturer, Distributor, Dealer, or Purchaser Permit DBPR-DDC DOH Form 233, effective April 2016 1672, ed. Aug. 94, which is incorporated by reference in Rule 61N-2.004, F.A.C. herein. To renew a permit which has not expired, been revoked, suspended or otherwise terminated, a person must file with the department a completed “Application for Diethyl Ether Permit Renewal Under Cchapter 499, F.S.,” DBPR-DDC Form 2 , https://www.flrules.org/agency/referenceList.asp#:~:text=http%3A//www.flrules.org/Gateway/reference.asp%3FNo%3DRef%2D13232 DOH Form 1034E, effective October 2014 January 1996, which is incorporated by reference herein.
