NOTICE IS HEREBY GIVEN that the Division of Florida Condominiums, Timeshares, and Mobile Homes, Department of Business and Professional Regulation, State of Florida, has received the petition for declaratory statement from Andrew P. Speranzini, Esq., In Re: City of Tamarac, Docket No. 2016029023, filed on June 17, 2016. The petition seeks the agency’s opinion as to the applicability of Sections 720.403-720.407, 720.301(9), 720.302(3)(a), 712.01(4), and 712.11, Florida Statutes, as they apply to the petitioner.
Whether the Association is entitled to utilize the revitalization procedures provided in Sections 720.403-720.407, Florida Statutes, due to the Association’s status as either a homeowner’s association under Sections 720.301(9) and 720.302(3)(a), Florida Statutes, or as a homeowner’s association not subject to Chapter 720, Florida Statutes, pursuant to Sections 712.01(4) and 712.11, Florida Statutes?
