    62-711.500Waste Tire Site Notification and Requirements

    The Department of Environmental Protection hereby gives notice that it has issued an order on June 21, 2016 granting Tire Express of Jacksonville, Inc.'s Petition for a waiver. The Petition was received on March 21, 2016. Notice of receipt of this Petition was published in the Florida Administrative Register on March 24, 2016. The Petition requested a waiver from paragraph 62-711.500(3)(a), Florida Administrative Code (F.A.C.), which requires that owners and operators of waste tire sites provide financial assurance in the amount of the closing cost estimate for the facility. No public comment was received. The Order, file number 16-0161, granted the Petition to paragraph 62-711.500(3)(a), F.A.C., based on a showing that Petitioner demonstrated that a strict application of the rule would result in substantial hardship to Petitioner or would affect Petitioner differently than other similarly situated applicants and because Petitioner demonstrated that the purpose of the underlying statute will be or has been achieved by other means.
