62-602.270Eligibility for Operator Examinations

The Department of Environmental Protection hereby gives notice that it has issued a Final Order Granting Petition for Variance (OGC File No. 17-0157) from paragraph 62-602.270(1)(a), F.A.C., to the School Board of Brevard County on June 13, 2017.The Petition for a Variance was received on March 31, 2017, and notice of receipt was published in the Florida Administrative Register on April 14, 2017; Vol. 43, No. 73. The Variance allows students enrolled in the Heritage High School Academy of Environmental Studies in Brevard County, Florida, to take the Level C Water/Wastewater Exam for the Operator Certification Program prior to high school graduation, subject to certain conditions. No public comment was received. The Final Order was issued based on a showing by the Petitioner that it will suffer a substantial economic hardship if students are precluded from taking the exam prior to obtaining a high school diploma because entry into the workforce would be delayed.
