The Board of Psychology hereby gives notice: that on June 11, 2020, an Order was filed on the Petition for Variance or Waiver. The Petition was filed by Mariza Giua, on March 6, 2020. Petitioner sought a variance or waiver of Rule 64B19-11.005(c), F.A.C., with regard to the requirement that a supervisor is either a licensed Florida psychologist in good standing with the Board, or a doctoral-level psychologist licensed in good standing in another state or United States territory or Canada providing supervision for licensure in that state or territory. However, where the psychology resident or post-doctoral fellow is on active duty with the armed services of the United States, or employed full time by the United States as a civilian psychology resident or post-doctoral fellow to provide services to the armed services or to a veterans administration facility, the supervisor may be a doctoral-level psychologist licensed in good standing in any state or territory, regardless of where the supervision is conducted.

The Notice of Petition for Variance or Waiver was published in Vol. 46, No. 49, on March 11, 2020, in the Florida Administrative Register. The Board, at its meeting held on April 24, 2020, voted to grant the Petition for Variance or Waiver finding that Petitioner demonstrated a substantial hardship; demonstrated that application of the rule would violate the principles of fairness; and demonstrated that the purpose of the underlying statute had been met.
