64-4.005Inspection and Authorization Procedures

The Department of Health hereby gives notice: On June 22, 2020, the Department issued an Order Granting Petition for Emergency Variance filed by Hart’s Plant Nursery, Inc. on May 21, 2020. The Petition sought an emergency variance from subsection 64-4.005(4), F.A.C., which requires that a Medical Marijuana Treatment Center begin dispensing product within 210 days of being granted Cultivation Authorization. The Petition was published by the Department on May 28, 2020, in Volume 46, Number 104 of the Florida Administrative Register. The Petitioner demonstrated that strict application of the rule would violate principles of fairness, that Petitioner would experience a substantial hardship if the Petition was not granted, and that Petitioner will satisfy the underlying purpose of the statute.
