The Board of Chiropractic Medicine hereby gives notice:

Of the issuance of an Order regarding the Petition for Waiver or Variance, which was filed on April 1, 2014, by Robert De Maria. The Notice of Petition for Waiver or Variance was published in Volume 40, Number 104, of the May 29, 2014, Florida Administrative Register. The Petitioner was seeking a waiver or variance of subsection 64B2-13.004(1), Florida Administrative Code, which requires that for the purpose of renewing a license, an applicant must demonstrate to the Board that he or she participated in at least forty (40) classroom hours of continuing chiropractic education during the past two years. The Board considered the instant Petition at a duly-noticed meeting, held June 6, 2014, in Orlando, Florida.

The Board’s Order, filed on June 20, 2014, denies the waiver of subsection 64B2-13.004(1), Florida Administrative Code. The Board finds that Petitioner did not meet the purpose of the underlying and failed to demonstrate that application of the rule at issue to Petitioner would violate principles of fairness. However, the Board voted to give the Petitioner an additional six (6) months from the filing date of this Final Order to obtain eight (8) hours of board approved continuing education.
