NOTICE IS HEREBY GIVEN that the Construction Industry Licensing Board has received the petition for declaratory statement from Pools by John Garner, Inc.The petition seeks the agency's opinion as to the applicability of Section 489.113(9)(a) F. S. as it applies to the petitioner.

The petition seeks the Board’s interpretation of paragraph 489.113(9)(a) F.S., as to whether a commercial swimming pool contractor, as part of a project to build a swimming pool and pool deck, can include in the contract the construction of a summer kitchen on the pool deck area as part of his scope of license and subcontract all other necessary work.
