The Board of Clinical Social Work, Marriage and Family Therapy and Mental Health Counseling hereby gives notice: of the issuance of an Order Denying the Petition for Variance and Waiver, filed by Carol A. Malenfant on January 3, 2024. The Notice of Petition for Waiver or Variance was published in Vol. 50, No. 06, of the January 9, 2024, Florida Administrative Register. Petitioner sought a waiver of paragraph 64B4-3.003(2)(b), Florida Administrative Code which states in pertinent part that applicants for licensure by endorsement may use the National Counselor Examination for Licensure and Certification (NCE) if the exam was taken prior to the year 2000. The Board considered the request at a duly-noticed public meeting held on February 23, 2024, via Microsoft Team Meating. The Board found that the petitioner has failed to establish that the Board’s application of paragraph 64B4-3.003(2)(b), F.A.C., to the petitioner’s circumstances would violate the principles of fairness or impose a substantial hardship and the Board further finds that the petitioner failed to demonstrate that the purpose of the underlying statute will be or has been achieved by other means. The Board’s Order, filed on April 3, 2024, denied the petition.
