NOTICE IS HEREBY GIVEN that the Board of Chiropractic Medicine has issued an order disposing of the petition for declaratory statement filed by Paul W. Lambert, Esquire on behalf of The Florida Chiropractic Association, Inc. and Robert Watkins, D.C. on December 3, 2013. The following is a summary of the agency’s disposition of the petition:

The Notice of Petition for Declaratory Statement published on December 5, 2013, in Vol. 39, No. 235, of the Florida Administrative Register. Petitioner sought the Board’s interpretation of Chapter 460, Florida Statutes, entitled, “Chiropractic Medicine,” as to whether a Florida licensed chiropractic physician using web based advertising under a contract with a web based company facilitating the advertisement to offer discounted vouchers for chiropractic services violates either Section 456.054 or Section 817.505(1), Florida Statues. The Board of Chiropractic Medicine considered the Petition at its meeting held on January 3, 2014, in Orlando, Florida. The Board's Order filed on January 13, 2014, states that the Florida Board of Chiropractic Medicine does not have jurisdiction to interpret Chapter 817, Florida Statutes, the Fraudulent Practices statute. The Board voted to answer the petition by stating that the advertising model of Groupon as described in the petition is not a kickback under state law as defined in Section 456.054, Florida Statutes.
