64B2-13.004Continuing Education
The Board of Chiropractic Medicine hereby gives notice of the issuance of an Order regarding the Petition for Waiver or Variance, which was filed on December 2, 2013, by Catherine A. George-Parisi, D.C. The Notice of Petition for Waiver or Variance was published in Volume 39, Number 235, of the December 5, 2013, Florida Administrative Register. The Petitioner was seeking a waiver or variance of subsection 64B2-13.004(2), Florida Administrative Code, “Continuing Education,” which requires that for the purpose of renewing a license, an applicant must demonstrate to the Board that he or she participated in at least forty (40) classroom hours of continuing chiropractic education during the past two years. It also appears petitioner is also seeking a waiver or variance from subsection 13.004(2), Florida Administrative Code, which requires that only those classroom hours earned at Board approved continuing education courses or under the provisions of this rule are acceptable. The Board considered the instant Petition at a duly-noticed meeting, held January 3, 2014, in Orlando, Florida.
The Board’s Order, filed on January 13, 2014, granted the petition finding that Petitioner had established that the purpose of the underlying statute would be met by granting a variance or waiver from Rule 64B2-13.004, F.A.C. The Board further finds that Petitioner established that applying the requirements of the aforementioned rule to her circumstances would violate principles of fairness and impose substantial hardship.
