68A-6.010Facility Requirements for Class I, II and III Wildlife

The Florida Fish and Wildlife Conservation Commission hereby gives notice:

that on May 26, 2020, the Florida Fish and Wildlife Conservation Commission issued an order denying a petition for a waiver from Rule 68A-6.010(3)(b)2., F.A.C., from Ms. Gena Walck of Heaven Help Us Animal Refuge. Ms. Walck filed her petition with the agency on April 20, 2020. A Notice of Waiver was published in the Florida Administrative Register, Vol. 46/85, dated April 30, 2020. No comments were timely received by the agency.

Rule 68A-6.010(3)(b)2., F.A.C., establishes the land area requirement of two and one-half (2 ½) acres for facilities housing Class II wildlife. The land area requirement for facilities housing Class II wildlife is to assure public safety. Ms. Walck did not provide any facts demonstrating that the purpose of the acreage requirement will be or has been achieved by other means and that the application of the rule would create substantial hardship or would violate principles of fairness as defined in Section 120.542(2), F.S.
