64B17-3.001:Licensure as a Physical Therapist by Examination

The Board of Physical Therapy hereby gives notice of the issuance of an Order regarding the Petition for Variance or Waiver for Raphaella Zacche, filed on October 1, 2012. The Notice of Petition for Variance or Waiver was published in Volume 38, No. 51, of the October 15, 2013, Florida Administrative Register. The Board considered the Petition at a duly-noticed public meeting held on November 2, 2012. The Petitioner sought a permanent variance or waiver of Rule 64B17-3.001, Florida Administrative Code, with regards to the requirement that a foreign graduate receive a determination that the credentials are equivalent to education required for licensure as a physical therapist in the United States as determined by the Foreign Credentialing Commission on Physical Therapy.

The Board’s Order, filed on November 19, 2012, grants the Petition for Variance or Waiver. The Petitioner has demonstrated that the Petition for Variance or Waiver was in substantial compliance with the provisions of Section 120.542, Florida Statutes, and Chapter 28-104, Florida Administrative Code. Petitioner meets the underlying purpose and has demonstrated that application of the rule would cause a substantial hardship and would violate the principles of fairness.
