    64B19-11.005:Supervised Experience Requirements

    The Board of Psychology hereby gives notice of the issuance of an Order regarding the Petition for Variance or Waiver for Sherri Belack-Raz, filed on February 20, 2013. The Notice of Petition for Variance and Waiver was published in Volume 39, No. 52, of the March 15, 2013, Florida Administrative Register. The Board considered the Petition at a duly-noticed public meeting held on March 22, 2013. The Petitioner was seeking a permanent variance or waiver of Rule 64B19-11.005, Florida Administrative Code, with regards to the requirement that applicants for licensure complete at least 2,000 hours of doctoral experience under a supervisor whose supervision comports with this rule.

    The Boards Order, filed on March 28, 2013, grants the Petition for Variance or Waiver. The Petitioner has demonstrated that the Petition for Variance and Waiver was in substantial compliance with the provisions of Section 120.542, Florida Statutes, and Chapter 28-104, Florida Administrative Code. Petitioner has demonstrated that she meets the purpose of the underlying statute. Petitioner has established that the purpose of the underlying statute, Section 490.005, Florida Statutes, would be met were the Petitioner to be granted a variance from the rule. The Petitioner has established that the Board’s application of Rule 64B19-11.005, Florida Administrative Code, to the Petitioner’s circumstances would violate the principles of fairness or would impose a substantial hardship. The Petitioner has provided sufficient evidence of attempts to contact the director or an APA accredited doctoral program in psychology to demonstrate that application of the rule to her circumstances would violate principles of fairness or would impose a substantial hardship. Further, Petitioner has demonstrated that application of the rule would cause a substantial hardship and would violate the principles of fairness. Accordingly, The Board finds that the Petition demonstrates that the purpose of the underlying statute has been or will be achieved and that application of the rule imposes a substantial hardship or violates principles of fairness.
