    64B19-11.0035: Licensure by Examination: Proof Satisfactory to the Board for the Purpose of Determining Eligibility for Examination

    The Board of Psychology hereby gives notice of the issuance of an Order regarding the Petition for Variance or Waiver for Ruth Prevor, Ph. D., filed on March 22, 2013. The Notice of Petition for Variance and Waiver was published in Volume 39, No. 67, of the April 5, 2013, Florida Administrative Register. The Board considered the Petition at a duly-noticed public meeting held on April 26, 2013. The Petitioner was seeking a permanent variance or waiver of Rule 64B19-11.0035, Florida Administrative Code, with regards to the requirement that applicants provide proof satisfactory to the Board that the applicant’s degree obtained outside of the United States or Canada was equivalent to a Ph.D., Psy.D., or an Ed.D. in psychology and obtained from a program equivalent to a program accredited by a programmatic accrediting agency recognized and approved by the US Department of Education.

    The Boards Order, filed on May 16, 2013, denies the Petition for Variance or Waiver. The Petitioner has not demonstrated that the Petition for Variance and Waiver was in substantial compliance with the provisions of Section 120.542, Florida Statutes, and Chapter 28-104, Florida Administrative Code. Petitioner has not demonstrated that she meets the purpose of the underlying statute. Further, Petitioner has not demonstrated that application of the rule would cause a substantial hardship and would violate the principles of fairness as Petitioner admits, she is requesting from the portion of the rule that as amended out of the rule in October 2011and the Board cannot vary or waive a portion o f a rule that no longer exists. On the contrary, application and variance or waiver of a portion of the rule that no longer exists would violate the principles of fairness.
