64B19-11.0035: Licensure by Examination: Proof Satisfactory to the Board for the Purpose of Determining Eligibility for Examination

The Board of Psychology hereby gives notice of the issuance of an Order regarding the Petition for Variance or Waiver for Maria Carmen Santana, Ph.D., filed on September 18, 2012. The Notice of Petition for Variance and Waiver was published in Volume 38, No. 59, of the October 26, 2012, Florida Administrative Register. The Board considered the Petition at a duly-noticed public meeting held on November 30, 2012. The Petitioner was seeking a permanent variance or waiver of subsection 64B19-11.0035(3), Florida Administrative Code, with regards to the requirement that applicants provide proof satisfactory to the Board that the applicant’s degree obtained outside of the United States or Canada was equivalent to a Ph.D., Psy.D., or an Ed.D. in psychology and obtained from a program equivalent to a program accredited by a programmatic accrediting agency recognized and approved by the US Department of Education.

The Board’s Order, filed on January 30, 2013, denies the Petition for Variance or Waiver. The Petitioner has not demonstrated that the purpose of the underlying statute, Section 490.005, Florida Statutes, would be met were the Petitioner to be granted a variance from the rule. Petitioner has not demonstrated that the Board’s application of the rule to the Petitioner’s circumstances would violate the principles of fairness or would impose a substantial hardship. The Petitioner has not provided sufficient evidence of attempts to contact the director of an APA accredited doctoral program in psychology to demonstrate that application of the rule to her circumstances would violate principles of fairness or would impose a substantial hardship.
