NOTICE IS HEREBY GIVEN that on May 18, 2017, the Board of Medicine has received the petition for declaratory statement from Publix Super Markets, Inc. The petition seeks the agency’s opinion as to the applicability of paragraph 64B8-44.002(3)(j), F.A.C., as it applies to the petitioner.
Specifically, Publix seeks the Board opinion regarding the application of the requirement of the rule to “conspicuously identify” the dietitian nutritionists by name in each piece of advertisement. The Dietetics and Nutrition Practice Council will consider this petition at its meeting currently scheduled for July 27, 2017. The Board of Medicine will consider this petition at its meeting currently scheduled for August 4, 2017. Except for good cause shown, motions for leave to intervene must be filed within 21 days after publication of this notice.
