The Board of Funeral, Cemetery, and Consumer Services hereby gives notice:

of the issuance of an Order regarding the Petition for Variance or Waiver filed on March 18, 2019 by Foundation Partners of Florida, LLC dba David C. Gross Funeral Home. The Notice of Petition for Variance and Waiver was published in Volume 45, No. 57, of the March 22, 2019 issue of the Florida Administrative Register. Petitioner sought a waiver or variance of subsection 69K-18.004(3), Florida Administrative Code, entitled, “Intern Training Agencies,” that lists the requirements for intern training agencies. The Board considered the petition at the duly-noticed public telephonic meeting held April 18, 2019 in Tampa, Florida.

The Board’s Order, filed on May 24, 2019, granted the petition finding that Petitioner had established that the purpose of the underlying statute would be met by granting a variance from subsection 69K-18.004(3), F.A.C. The Board further found that Petitioner established that applying the requirements of the aforementioned rule to its circumstances would violate principles of fairness and impose substantial hardship.
