NOTICE IS HEREBY GIVEN that the Board of Physical Therapy Practice has declined to rule on the petition for declaratory statement filed by Chris Gellert on January 30, 2017. The following is a summary of the agency’s declination of the petition:

The Board of Physical Therapy Practice hereby gives notice of the issuance of a Final Order on the Petition for Declaratory Statement, original Petition filed on January 30, 2017 and amended Petition filed on April 5, 2017, by Chris Gellert. The original Notice of Petition for Declaratory Statement was published in Vol. 43, No. 60, of the March 28, 2017 Florida Administrative Register. The Board considered the Petition at a duly-noticed public meeting on May 4, 2017. Petitioner sought a declaratory statement requesting clarification of the use of Instrument Assisted Soft Tissue Mobilization (IASTM). Petitioner did not cite any specific statute or rule for which a determination is requested. The Board found that the Petitioner did not demonstrate legal standing to be granted a declaratory statement as he was not licensed by or an applicant for licensure from the Florida Board of Physical Therapy Practice. Accordingly, the Board denied the Petition for Declaratory Statement. The Order was filed on May 19, 2017.
