NOTICE IS HEREBY GIVEN that the Department of Financial Services, Division of State Fire Marshal (Department), has issued an order disposing of the petition for declaratory statement filed by City of Avon Park, Florida (Petitioner) on March 10, 2016. The following is a summary of the agency’s disposition of the petition:

Avon Park’s City Manager and Public Safety Director would not have the requisite knowledge and certifications in order to be the administrator and command head over the fire department in Avon Park. However, the statute and rules do not address purely administrative and executive tasks involved in the local government’s (including municipalities, counties, political subdivisions, and fire districts) general oversight and management of the local fire department.
