PURPOSE AND EFFECT: With the passage of Ch. 2013-36, LOF, the Commission needed to create a form to be used by a trustee when certifying a public officer's qualified blind trust pursuant to Section 112.31425, F.S. The Commission also needed to revise the voting conflict forms--Forms 8A and 8B--to include changes in the law affecting state and local officers.

SUBJECT AREA TO BE ADDRESSED: The proposed forms include the certification form that a trustee will file with the Commission when certifying that a public officer's blind trust complies with Section 112.31425, F.S., as well as the voting conflict form used by state and local officials when voting.

(1) The following forms and instructions are adopted by reference and are used by the Commission in its dealings with the public:

(a) through (d) No change.

(e) Form 8A, Memorandum of Voting Conflict for State Officers. To be utilized by public officers serving at the State level of government for compliance with Section 112.3143, F.S. Effective _______ 1/2000.

(f) Form 8B, Memorandum of Voting Conflict for County, Municipal, and Other Local Public Officers. To be utilized by public officers serving at local levels of government for compliance with Section 112.3143, F.S. Effective ______ 1/2000.

(g) through (i) No change.

(j) Form 40, Certification by Trustee of Qualified Blind Trust. To be utilized by trustee when certifying that a public officer's blind trust complies with Section 112.31425, F.S. Effective.
