The Board of Clinical Laboratory Personnel hereby gives notice:
of the issuance of an Order regarding the Petition for Waiver or Variance, which was filed on August 13, 2009, by Salome R. Zapanta. The Notice of Petition for Waiver or Variance was published in Volume 35, Number 35, of the September 4, 2009, Florida Administrative Weekly. The Petitioner was seeking a waiver or variance of subsection 64B3-6.002(7), Florida Administrative Code, entitled “Documentation for Licensure,” which requires that individuals with a baccalaureate degree in accredited medical technology programs from accredited institutions in the Philippines, submit official transcripts sent directly by the institution to the Board office.
The Board considered the instant Petition at a duly-noticed meeting held October 16, 2009 via teleconference. The Board’s Order, filed on October 21, 2009, granted the petition, finding that Petitioner had established that the purpose of the underlying statute would be met by granting a variance or waiver from subsection 64B3-6.002(7), F.A.C. The Board further finds that Petitioner established that applying the requirements of the aforementioned rule to her circumstances would violate principles of fairness and impose substantial hardship.
