    Final Order No. DEO-16-114

    NOTICE IS HEREBY GIVEN that the Florida Department of Economic Opportunity issued Final Order No. DEO-16-114 on June 30, 2016, in response to an application submitted by Our Place Homeowners’ Association, Inc., for covenant revitalization under Chapter 720, Part III, Florida Statutes.

    The Department’s Final Order denied the application for covenant revitalization after determining that it did not meet the statutory requirements as the Association failed to create an organizing committee of at least three parcel owners, violating Section 720.405(1), Florida Statutes; failed to submit a proposed revised declaration of covenants to the parcels owners and failed to identify the parcels that were subject to the governing documents, violating Section 720.405(2), Florida Statutes; failed to provide the parcel owners with the complete text of the proposed articles of incorporation and bylaws, violating Section 720.405(3), Florida Statutes; failed to provide the Department with the previous governing documents, violating Section 720.405(4); failed to provide the parcel owners with the proposed revived declaration of covenants, the proposed new or existing articles of incorporation and bylaws, and a graphic depiction of the properties governed by the revived declaration, violating Section 720.405(5), Florida Statutes; failed to provide documentation of the affected parcel owners’ consent to the proposed revived declaration, violating Section 720.405(6); failed to submit documentation showing the affected parcel owners consented to the proposed revived governing documents and verified copies of previous governing documents to the Department within 60 days of the parcel owners’ approval, violating Section 720.406(1), Florida Statutes; failed to provide a verified copy of the previous declaration of covenants and other previous governing documents, violating Section 720.406(1)(b), Florida Statutes; failed to provide the legal description of each parcel subject to the revived declaration, violating Section 720.406(1)(c), Florida Statutes; and failed to provide either a verified copy of the affected parcel owners’ written consents approving the revived declaration or verified copies of the notice of the meeting notice, attendance, and voting results, if a meeting was held, violating Section 720.406(1)(d), Florida Statutes.
