NOTICE IS HEREBY GIVEN that the Florida Building Commission has declined to rule on the petition for declaratory statement filed by Excel Electrical Group, LLC on March 20, 2019. The following is a summary of the agency's declination of the petition: The provision which the local building department cited as authority for requiring Petitioner to install an arc fault breaker is a purely local amendment to the Florida Building Code. Additionally, the Petitioner inquires about a situation in which it has already acted, and in which the local authority having jurisdiction has already issued its order. As the Commission is without authority to interpret local amendments to the Florida Building Code, and this Petition involves conduct that has already occurred, the Commission declines to answer the Petition.
