    PURPOSE AND EFFECT: The proposed rule amendments are intended to delete unnecessary language; to incorporate by reference the reference activity and supervisory plan; and to add language requiring new assistants to notify the Department of new assistants and other changes.

    SUMMARY: The proposed rule amendments delete language which is unnecessary; incorporate the activity and supervisory plan in the rule; and adds language requiring new assistants to notify the Department of new assistants and other changes.

    SUMMARY OF STATEMENT OF ESTIMATED REGULATORY COSTS AND LEGISLATIVE RATIFICATION:

    The Agency has determined that this will not have an adverse impact on small business or likely increase directly or indirectly regulatory costs in excess of $200,000 in the aggregate within one year after the implementation of the rule. A SERC has not been prepared by the agency.

    The Agency has determined that the proposed rule is not expected to require legislative ratification based on the statement of estimated regulatory costs or if no SERC is required, the information expressly relied upon and described herein: During discussion of the economic impact of this rule at its Board meeting, the Board, based upon the expertise and experience of its members, determined that a Statement of Estimated Regulatory Costs (SERC) was not necessary and that the rule will not require ratification by the Legislature. No person or interested party submitted additional information regarding the economic impact at that time.

    Any person who wishes to provide information regarding a statement of estimated regulatory costs, or provide a proposal for a lower cost regulatory alternative must do so in writing within 21 days of this notice.

    THE FULL TEXT OF THE PROPOSED RULE IS:

    64B20-4.001 Certification of Assistants.

    (1) Any person desiring to be certified as a speech-language pathology assistant or audiology assistant shall apply to the Department of Health. The application shall be made on Form DH-SPA-3, Application for Speech-Language Pathology or Audiology Assistant Certification, which is incorporated by reference herein, revised October, 2012, and can be obtained from http://www.flrules.org/Gateway/reference.asp?No=Ref-02877 or the Board of Speech-Language Pathology and Audiology, Department of Health, 4052 Bald Cypress Way, Bin #C-06, Tallahassee, Florida 32399-3256 or at http://www.doh.state.fl.us/mqa/speech/index.html. Such application and application fee required pursuant to Rule 64B20-3.002, F.A.C., shall expire one year from the date on which the application and fee are initially received in the Board office. After the period of one year, a new application and application fee must be submitted.

    (2) The Board shall certify as eligible for an assistant certificate only those applicants who have submitted a completed application form, and a supervisory plan which satisfies the criteria established by Rule 64B20-4.004, F.A.C., remitted the nonrefundable application fee required by Rule 64B20-3.002, F.A.C., the initial certificate fee established by Rule 64B20-3.008, F.A.C., and who have demonstrated to the Board that they satisfy the educational requirements elaborated in Rule 64B20-4.002, F.A.C.

    64B20-4.003 On-the-Job Training, Role and Observation of Speech-Language Pathology and Audiology Assistants.

    (1) – (2) No change.

    (3) The speech-language pathology or audiology licensee shall notify the Department within thirty (30) days of any changes in the roster of assistants registered under his or her name by submitting Form DH-MQA 1269 (4/13), entitled “Board of Speech-Language Pathology and Audiology Assistant Activity and Supervisory Plan,” hereby adopted and incorporated by reference, and can be obtained from the following website at http://www.doh.state.fl.us/mqa/speech/index.html.

    (4) – (11) No change.

    64B20-4.004 Supervision of Speech-Language Pathology Assistants and Audiology Assistants.

    (2) Any licensee who employs a speech-language pathology assistant or audiology assistant shall notify the Department of all new assistants or other changes in assistants under the licensee’s supervision by submitting Form 1269, entitled “Board of Speech-Language Pathology and Audiology Assistant Activity and Supervisory Plan” set forth in Rule 64B20-4.003, and the licensee also shall:

    (a) through (f) No change.

    (3) through (5) No change.
