    11B-27.002Certification, Employment or Appointment, Reactivation, and Terminating Employment or Appointment of Officers

    NOTICE IS HEREBY GIVEN that on July 6, 2016, the Criminal Justice Standards and Training Commission received a petition for a temporary waiver of paragraph 11B-27.002(4)(a), F.A.C., from Janet Hartman, Chief of Law Enforcement, Division of Alcoholic Beverages and Tobacco, Department of Business and Professional Regulation on behalf of Stephanie Stanley. The Petitioner wishes to temporarily waive for 30 days that portion of the rule that states: within four years of the beginning date of a Commission-approved Basic Recruit Training Program, an individual shall successfully complete the program, achieve a passing score on the applicable State Officer Certification Examination, and gain employment, and certification as an officer. Petitioner states that Stephanie Stanley is being considered for the position of Reserve Special Agent with the Division of Alcoholic Beverages and Tobacco (DABT). Petitioner states that Ms. Stanley successfully completed a Commission-approved Basic Recruit Training Program that began on September 27, 2011 and concluded on June 18, 2012, achieving a passing score on the State Officer Certification Examination (SOCE) on June 27, 2012. Petitioner states that due to maternity leave, Ms. Stanley’s re-certification date of September 27, 2015 has expired. Petitioner states that Ms. Stanley is currently employed with DABT as a civilian employee and is seeking a non-paid position of Reserve Special Agent which requires her to be a certified law enforcement officer. Petitioner states that strict application of the rule creates a substantial hardship and violates principles of fairness because repeating the training and exam again after the time and expense she has previously extended would cause her economic hardship and that It is Ms. Stanley’s desire to acquire the necessary experience through the Reserve Special Agent Program to eventually become a full-time law enforcement officer with DABT. Petitioner state the purpose of the underlying statute would be achieved if the waiver is granted.
