    PURPOSE AND EFFECT: The proposed rule amendment is intended to incorporate a licensure fee in the amount of $424 for active duty military and veterans practicing in areas of critical need.

    SUMMARY: The proposed rule amendment implements a licensure fee in the amount of $424, and allows this fee to be waived if the applicant is not compensated for his or her services. The rule amendment also deletes duplicative language in subsection (2) of the rule.

    SUMMARY OF STATEMENT OF ESTIMATED REGULATORY COSTS AND LEGISLATIVE RATIFICATION: The Agency has determined that this will not have an adverse impact on small business or likely increase directly or indirectly regulatory costs in excess of $200,000 in the aggregate within one year after the implementation of the rule. A SERC has not been prepared by the Agency.

    The Agency has determined that the proposed rule is not expected to require legislative ratification based on the statement of estimated regulatory costs or if no SERC is required, the information expressly relied upon and described herein: During discussion of the economic impact of this rule at its Board meeting, the Board concluded that because the proposed amendment will apply to a very limited number of applicants, the licensure fee will not negatively impact licensees and their businesses or the businesses that employ them. Additionally, the rule permits the licensure fee to be waived in instances where the applicant is not compensated for his or her services. The amendment to this rule will not increase any business costs, personnel costs, will not decrease profit opportunities, and will not require any specialized knowledge to comply. This change will not have any direct or indirect regulatory cost impact. Hence, the Board determined that a Statement of Estimated Regulatory Costs (SERC) was not necessary and that the rule will not require ratification by the Legislature. No person or interested party submitted additional information regarding the economic impact at that time.

    Any person who wishes to provide information regarding a statement of estimated regulatory costs, or provide a proposal for a lower cost regulatory alternative must do so in writing within 21 days of this notice.

    THE FULL TEXT OF THE PROPOSED RULE IS:

     

    64B8-3.002 Application, Certification, Registration, and Licensure Fees.  The following fees are prescribed by the Board:

    (1) No change.

    (2) An application fee in the amount of $300.00 for a person desiring to obtain temporary certificate to practice in areas of critical need, as provided in Section 458.315, F.S., and a temporary certificate to practice in an approved cancer center, as provided in Section 458.3135, F.S., and a temporary certificate to obtain medical privileges for instructional purposes in conjunction with certain plastic surgery or other medical or surgical training programs and educational symposiums, as provided in Section 458.3137, F.S.

    (3) through (6) No change.

    (7) The initial certification fee for any person who is issued a temporary certificate to practice in areas of critical need, temporary certificate for active duty military and veterans practicing in areas of critical need, public health certificate, public psychiatry certificate, or medical faculty certificate and the initial license fee for a person who is issued a license to practice as a physician as provided in Section 458.311, 458.3115, 458.3124, or 458.313, or 458.3151, F.S.; or a limited license as provided in Section 458.317, F.S., shall be $424.00 with the following exceptions:

    (a) through (d) No change.

    (e) For any person applying for a temporary certificate to practice in areas of critical need, as provided in Section 458.315, F.S., and for any person applying for a temporary certificate for active duty military and veterans practicing in areas of critical need, pursuant to Section 458.3151, F.S., who submits an affidavit from the employing agency or institution stating that the applicant will not receive monetary compensation for any service involving the practice of medicine, the initial certification fee shall be waived.

    (8) through (9) No change.
