    NOTICE OF CHANGE

    Notice is hereby given that the following changes have been made to the proposed rule in accordance with subparagraph 120.54(3)(d)1., F.S., published in Vol. 41 No. 116, June 16, 2015 issue of the Florida Administrative Register.

    20-3.005 General Provisions.

    (2)(b) 1. c. Fruit contracted for multi-years and/or future seasons For multi-year future season (Long Term Contract-basis).

    2. Fruit contracted with no price Prices in these contracts need not be specified at the time the contract is executed; written, but however, the price must be calculable at time of fruit delivery.

    (2)(j) 1. c. For which Which only the Intermediate Price is available during week of delivery/processing.; and

    d. 2. For which the Final Price or pricing basis for the 'rise' is not known during the week of delivery/processing due to This category may also include contracts with ‘floor’ and ‘rise’ language in the executed contract if the Final Price or pricing basis for the ‘rise’ is not known during the week of delivery/processing.

    (4) Reports as required under this rule chapter are subject to the inspection of records provision of s. 601.70, Fla. Stat.

     

    20-3.007(5) Each entity required to report shall have a representative attend reporting training to be held at the Florida Department of Citrus building, led by staff, on a date to be announced prior to the beginning of each fruit season.

    20-3.010 Post Estimate Fruit Pricing Verification Report.

    All licensed citrus fruit dealers engaged in the processing of processed citrus products or delivery of fruit for toll pack processing, shall file a post estimate fruit pricing verification report twice a season, after the end of each facility's completing processing of early season fruit and late season fruit.  Fruit pricing verification reports shall be submitted on forms provided by the Department of Citrus and incorporated by reference into Rule 20-100.004, F.A.C., and shall be delivered by email to the location designated on the aforementioned forms.  The reports are to be utilized by staff in preparing the Post-Estimate Price Report.
