NOTICE IS HEREBY GIVEN that the Construction Industry Licensing Board has issued an order disposing of the petition for declaratory statement filed by Richard Santelli on January 27, 2015. The following is a summary of the agency’s disposition of the petition:
The Notice of Petition for Declaratory Statement was published in Volume 41, No. 78, of the April 22, 2015, Florida Administrative Register. The petition seeks a declaratory statement from the Board as to whether general site work, not related to construction of a building, is included in the building cost under Section 489.103(7), Florida Statutes. The Board’s Order, filed on June 25, 2015, declines to issue a declaratory statement in this matter because the Petition does not state with particularity the Petitioner’s set of circumstances as required by Section 120.565(2), Florida Statutes, and because Petitioner is not a substantially affected person as required by Section 120.565(1), Florida Statutes.
