    NOTICE IS HEREBY GIVEN that the Public Employees Relations Commission has received the petition for declaratory statement from Robert Michael Ardis, Case No. DS-2015-001. The petition seeks the agencys opinion as to the applicability of Article 1, Sections 21 and 22 of the Florida Constitution and Sections 447.205 and 447.207, Florida Statutes (2014), as it applies to the petitioner.

    The Petitioner seeks the Commission to hold that he has the statutory and constitutional right to bring causes of action in court against the Pensacola State College Faculty Association (Union), the Union’s officer’s and administrators, and its former officers and administrators alleging that they have committed tortious actions against him such as, but not limited to, invasion of privacy, intentional infliction of emotional distress, and conspiracy. The Petitioner also seeks the Commission to hold that a determination of whether these actions is tortious is outside of the Commission’s jurisdiction but which is within the jurisdiction of the Circuit Court of Florida and within the jurisdiction of the United States Circuit Court of Appeals, Eleventh Circuit. The Petitioner seeks the Commission to declare that there is no legal justification for the Union defendants’ argument to the courts that the Commission’s mere existence precludes the Petitioner from suing them.
