    NOTICE IS HEREBY GIVEN that the Division of Florida Condominiums, Timeshares, and Mobile Homes, Department of Business and Professional Regulation, State of Florida, has received the petition for declaratory statement from Dave Jaye, Linda Berkman, Tom Breyer, Peter C. Salamoun and Larry Mayer, In Re: Seascape of Little Hickory Island, Inc., Docket No. 2019036062. The petition seeks the agency's opinion as to the applicability of 718.108. 718.113 and 718.115 as it applies to the petitioner.

    1. Whether the twenty slip dock that is used by all owners at Seascape is considered a common element. 2. Whether the Association is permitted to selectively assess all fees related to the twenty slip dock to the specific owners of the boat lifts. 3. Whether the owners of the boat lifts are in a position to be reimbursed for fees that have been paid to the association for the twenty slip dock.
