NOTICE IS HEREBY GIVEN that Agency for Health Care Administration has received the petition for declaratory statement from Chatsworth at PGA National, LLC and The Devonshire at PGA National, LLC. The petition seeks the agency’s opinion as to the applicability of Fla. Stat. § 400.062(2), as it applies to the petitioner.

The issues needing determination are (1) whether Fla. Stat. 400.062(2) would allow for a separate license to be obtained to provide outpatient therapy services allowed under the nursing home statutes and (2) whether the services at the separate premises would be subject only to the licensing rules that apply to a nursing facility’s provision of outpatient therapy services.
