NOTICE IS HEREBY GIVEN that on April 12, 2019, the Department of Agriculture and Consumer Services, received a petition for Waiver from Grace H. Yang, as counsel for Anheuser Busch, LLC. Notice of receipt of the Petition was published in Vol. 45, No. 49 of the Florida Administrative Register on April 23, 2019.

Petitioner requested a permanent waiver from subsections 5E-14.111(2) and (3), F.A.C., which mandates requirements regarding structural fumigation and the evacuation of all occupants during the time of fumigation. Specifically, Petitioner requested a waiver of the requirement to vacate all connected structures during the fumigation.

On May 8, 2019, the Department sent a Request for Additional Information. Petitioner’s response was received on June 11, 2019.

On July 18, 2019, the Department issued an order granting the petition because the Petitioner demonstrated that its proposal to tape, seal and montior the fumigated area of the structure achieved the safety purposes of the underlying statute. Petitioner also demonstrated the existence of a substantial hardship should they be required to vacate the entire structure.
