NOTICE IS HEREBY GIVEN that Department of Financial Services, Division of State Fire Marshal (Department), has received the petition for declaratory statement from Ken Bennett, Fire Marshal – Lehigh Acres Fire Control and Rescue District, on June 25, 2020.The petition seeks the agency's opinion as to the applicability of NFPA 101-7.2.1.11. as it applies to the petitioner.

The Petition asks whether security gates that automatically open for ingress and which require a force of five pounds or more to open to egress within a structure, and so located within the aisle of a mercantile occupancy to reach an exit door, are the swing gates required to comply with the provisions of NFPA 101-7.2.1.11.
