NOTICE IS HEREBY GIVEN that Construction Industry Licensing Board has issued an order disposing of the petition for declaratory statement filed by Susan Buckley on June 29, 2020. The following is a summary of the agency's disposition of the petition: The Petitioner sought a determination from the Board regarding the State of Florida licensing requirements for an unlicensed modular home retailer to perform general contractual services while under contract with Petitioner. The Notice of Petition for Declaratory Statement was published in Vol. 46, No. 46, on March 6, 2020, in the Florida Administrative Register. The Board, at its meeting held on May 15, 2020, declined to answer the Petition for Declaratory Statement, finding that the provisions of Section 489.128 and subsection 489.105(6), F.S. are clear and that due to the scope of practice questions, also because the actions Petitioner asked the Board to render a Declaratory Statement on have already occurred, therefore Petitioner has not established standing.

A copy of the Order Disposing of the Petition for Declaratory Statement may be obtained by contacting: Daniel Biggins, Executive Director, Construction Industry Licensing Board, 2601 Blair Stone Road, Tallahassee, Florida 32399-1039 or telephone: (850)487-1395, or by electronic mail to Donald.Shaw@myfloridalicense.com.
