NOTICE IS HEREBY GIVEN that Construction Industry Licensing Board has issued an order disposing of the petition for declaratory statement filed by Victor J. Cavaleri on June 29, 2020. The following is a summary of the agency's disposition of the petition: The Petitioner sought a determination from the Board regarding the State of Florida licensing exemption requirements for a licensed general contractor who applies for a permit on behalf of a Florida county in the course of his employment in the discharging of his duties, as it pertains to statute. The Notice of Petition for Declaratory Statement was published in Vol. 46, No. 46, on March 6, 2020, in the Florida Administrative Register. The Board, at its meeting held on May 15, 2020 declined to answer the Petition, finding that the provisions of subsection 489.103(3) F.S. are clear and that due to the scope of practice questions, also because the actions Petitioner asked the Board to render a Declaratory Statement on have already occurred, therefore Petitioner has not established standing.
