2A-5.005: Minimum Safety Standards for Convenience BusinessesDivision of Victim Services and Criminal Justice Programs The Department of Legal Affairs, Division of Victim Services and Criminal Justice Programs, hereby gives notice that it has issued an Order on the Petition for Waiver and Variance filed on behalf of Circle K Stores, Inc. The petition seeks a waiver or variance from Rule 2A-5.005, F.A.C., in regard to the requirement regarding test photos and remote triggering devices. The Petition was filed on May 7, 2007. The Notice was published in Vol. 33, No. 21, of the May 25, 2007, Florida Administrative Weekly (F.A.W.), and the Amended Notice was published in Vol. 33, No. 25, of the June 22, 2007, F.A.W. The Division Director determined that the petition should be granted for the following reasons: the Petitioner presented evidence that the purpose of the underlying statute has been met through the use of a superior digital recording, and that application of the rule would violate the principles of fairness in this matter. The Order granting the Petition was filed on July 2, 2007.
