40E-6.221: Conditions for Issuance of Standard Permits

NOTICE IS HEREBY GIVEN THAT on June 28, 2007, South Florida Water Management District (District) received a petition for waiver from Alligator Alley Pipeline Company Application No. 06-1113-1, for utilization of Works or Lands of the District known as the North New River Canal and Water Conservation Area 3A, Broward County for proposed testing of an existing petroleum transmission line, chain link fence enclosure and above ground valves within the south right of way of the North New River Canal, Section (multiple) Township 50 South, Range 37 East through 41 East. The petition seeks relief from subsections 40E-6.011(4) and (6), Florida Administrative Code, which prohibits above ground structures within 40' feet of top of canal bank, and paragraph 40E-6.221(2)(j), Florida Administrative Code, which prohibits placement of transmission lines within Works or Lands of the District.
