    NOTICE OF CORRECTION

    Notice is hereby given that the following correction has been made to the proposed rule in Vol. 38, No. 26, June 29, 2012 issue of the Florida Administrative Weekly.

    STATEMENT OF ESTIMATED REGULATORY COSTS AND LEGISLATIVE RATIFICATION: The Commission's staff have determined that these proposed rules will not have an adverse impact on small business or likely increase directly or indirectly regulatory costs in excess of $200,000 in the aggregate within one year after the implementation of the rule. A SERC has not been prepared by the agency. The Agency has determined that the proposed rules are not expected to require legislative ratification based on the statement of estimated regulatory costs or if no SERC is required, the information expressly relied upon and described herein: The Commission has determined that the proposed rules will not require legislative ratification pursuant to Section 120.541(3), FS., or other applicable statutes, for the following reasons: 1) no requirement for SERC was triggered under Section 120.541(1), FS., and 2) clarification of the probable cause hearing procedures and the procedures to be awarded attorney's fees and costs pursuant to Section 112.317(7), FS., would not be expected to exceed any one of the economic analysis criteria set forth in Section 120.541(2)(a), FS.
