    NOTICE IS HEREBY GIVEN that the Division of Pari-Mutuel Wagering, Department of Business and Professional Regulation, has issued a Declaratory Statement in response to a petition for a declaratory statement from Pari-Mutual Live Racing Games, Inc., Petitioner, in DBPR Case No. DS 2006-020. The Petition lists Sections 550.155(1) and 550.3551(3), Florida Statutes, and subsection 61D-7.001(9) and Rule 61D-7.020, Florida Administrative Code, as the statutory/administrative provisions upon which a declaratory statement is being sought. The Declaratory Statement advises that: the device, whose functions and operating details are set forth in paragraphs five through twenty-eight of the Petition, is permissible for use at Florida licensed pari-mutuel facilities, provided that compliance with all applicable statutory and administrative wagering regulations is maintained. However, this Declaratory Statement is exclusively limited to devices of the same configuration and using the same operating protocols as those the Petitioner has described in paragraphs five through twenty-eight of the Petition.
